DPWH files bid rigging complaints vs 2 contractors before Philippine Competition Commission

MANILA, Philippines — The Department of Public Works and Highways (DPWH) has filed bid rigging complaints against two contractors before the Philippine Competition Commission (PCC) in connection with the three ghost and substandard flood control projects in Davao Occidental and La Union.

Public Works Secretary Vince Dizon on Thursday identified the erring contractors as St, Timothy Construction Corp. owned by the Discaya family, and Silverwolves Construction Corp.

Also included in the complaint were the officials and employees of DPWH Davao Occidental and La Union 2nd District Engineering Offices The three anomalous projects were in Culaman, Jose Abad Santos, Davao Occidental and in Bauang, La Union.

The DPWH has forwarded 15 questionable contracts to the PCC after the two agencies filed a memorandum of agreement last month, which formalized their cooperation in detecting and addressing anti-competitive behavior in public works projects, including bid-rigging and abuse of dominance.

Dizon said some P3.13 billion in fines could be imposed on the contractors involved if proven guilty for manipulation of public works projects.

Section 14, Chapter III of Republic Act 10667 or the Philippine Competition Act, prohibits price fixing at an auction or in any form of bidding, including cover bidding, bid suppression, bid rotation and market allocation and other analogous practices of bid manipulation.
